Elevate Your Ping websites and mobile applications ("Services" or "Service") are operated by Elevate Play Pty Ltd ("Elevate Play", "us" or "we").
Access and use of the Service is subject to the following Terms and Conditions ("Terms").
By accessing or using any part of the Service, you represent that you have read, understood, and agree to be bound by these Terms and Conditions including any future modifications.
We may amend, update or change these Terms and Conditions. If we do this, we will post a notice that we have made changes to these Terms and Conditions on the Services and will indicate at the bottom of the Terms and Conditions the date these terms were last revised.
Any revisions to these Terms and Conditions will become effective immediately. If you do not agree to abide by these Terms and Conditions, you are not authorized to use, access or participate in the Service.
Elevate Your Ping offers subscription plans that provide AI credits for match analysis and access to premium training content. You may also purchase consumable credit packs separately.
Payment will be charged to your iTunes Account or Google Play Account at confirmation of purchase.
Subscriptions automatically renew unless auto-renew is turned off at least 24-hours before the end of the current period.
Account will be charged for renewal within 24-hours prior to the end of the current period at the rate of your selected plan, as displayed at the time of purchase.
This Service offers optional Auto-renewable subscriptions to access additional content. Subscription pricing and available plans will be displayed at the time of purchase.
Subscriptions may be managed by the user and auto-renewal may be turned off by going to the user's Account Settings on the device.
Any unused portion of a free trial period, if offered, will be forfeited when the user purchases a subscription.

The Service allows users to access and use a variety of training and educational services related to table tennis, including AI-powered video analysis of matches, structured training programs, exercise libraries, and professional coaching feedback. Users can access these features through subscription plans that provide AI credits for match analysis, or purchase consumable credit packs for individual analyses without a subscription.
You must register for an account by providing a username, a valid email address and any other information we may require from time to time (“Account”).
You are responsible for maintaining the confidentiality of your Account details and you are fully responsible for all activities that occur under your Account.
Your Account must be used only by you and must not be shared with, or transferred to any other individual. You must immediately notify us via our Contact Us page of any suspected or actual, unauthorized or fraudulent use of your Account or any other breach of security.
Your Account can be accessed from multiple devices at a time as per the following limit: one (1) phone, one (1) tablet and one (1) computer/laptop maximum per account.
We reserve the right to suspend or terminate your Account if we, acting reasonably, suspect it does not comply with our Terms and Conditions. (Example: If multiple individuals share the same account or an individual creates multiple accounts).
As a condition of submitting any ratings, reviews, information, data, text, photographs, videos, match recordings ("Content"), you hereby grant to Elevate Play a royalty free, perpetual, irrevocable, worldwide, nonexclusive, transferable, and sublicensable license to use, reproduce, copy, adapt, modify, merge, distribute, publicly display, create derivative works from, incorporate such Content into other works; sublicense through multiple tiers the Content, and acknowledge that this license cannot be terminated by you once your Content is submitted to the Services.
You represent that you own or have secured all legal rights necessary for the Content submitted by you to be used by you, Elevate Play, and others as described and otherwise contemplated in these Terms and Conditions. You understand that other users will have access to the Content and that neither they or Elevate Play have any obligation to you or anyone else to maintain the confidentiality of the Content.
We take your privacy very seriously. Any personal information you submit to us when setting up an Account shall be subject to our Privacy and Cookie Policies located on our Privacy Policy page which are incorporated into these Terms.
You understand that through your use of the Services, you consent to the collection and use (to the extent stated in the Privacy and Cookie Policies) of this information.
All financial transactions made in connection with the Service will be processed by a third party payment processor (Stripe and PayPal) in accordance with their respective terms of use, privacy policy, and/or any applicable payment terms and conditions.
We encourage you to learn about the practices of such third party. In no event will Elevate Play be responsible for the actions or inactions of any third party payment processor, including, but not limited to, system downtime or payment service outages.
All packages must be purchased via our Website or Elevate Your Ping iOS or Android mobile apps only. Packages purchased outside our Service using third party individuals or resellers will be forfeited and Accounts linked to these purchases will be suspended.
Your registration to use our Services constitutes your consent to receive email communications from us, including messages regarding customer service and Login issues and other matters.
You may opt not to receive email correspondence, other than technical notifications and email regarding issues related to your account and your use of the Services, at any time by following the link included in the email messages.
We acknowledge to reasonably limit the number of marketing emails we sent you.
In the event that Elevate Play suspends or terminates your use of the Service or these Terms and Conditions as a result of a breach of these Terms, you understand and agree that you will receive no refund or exchange of any kind, including for any unused AI credits, any Content or data associated with your use of the Service, or for anything else.
We also do not refund simply for change of mind. You understand that you may have access to free features or trial periods that give you the chance to be fully aware of the product you are purchasing.
When you decide to opt in for one of our plans or purchase credits, we consider that you have performed your due diligence.
While we will do our best to provide you with accurate analysis, helpful training content, and quality coaching feedback to improve your table tennis skills, we do not guarantee specific performance improvements or competitive results.
The Service, including all images, videos, and other content therein, and any other information, property and rights granted or provided to you by Elevate Play are provided to you on an "as is" basis.
The Service may contain links to third-party websites, advertisers, services, special offers, or other events or activities that are not owned or controlled by Elevate Play. We do not endorse or assume any responsibility for any such third-party sites, information, materials, products, or services. If you access any third party website, service, or content from Elevate Play, you understand that these Terms and Conditions and our Privacy Policy do not apply to your use of such sites. You expressly acknowledge and agree that Elevate Play shall not be responsible or liable, directly or indirectly, for any damage or loss arising from your use of any third-party website, service, or content.
The Service may include advertisements, which may be targeted to the Content or information on the Service, or other information. The types and extent of advertising by Elevate Play on the Service are subject to change. In consideration for Elevate Play granting you access to and use of the Service, you agree that Elevate Play and its third party providers and partners may place such advertising in connection with the display of content or information submitted by you or others.
You acknowledge and warrant that we, our employees and contractors, are not and shall not be liable to you for any damages, including but not limited to loss of profit, inaccurate results, loss or corruption of Your Content or any data, data being inaccurate, the cost of recovering any data or Your Content, inability to access the Services, the cost of substitute services, even where we have been advised of the possibility of such damages.
We only provide our site for consumer private use. You agree not to use our site for any commercial or business purposes, and we have no liability to you for any loss of profit, loss of business, business interruption, or loss of business opportunity.
We do not exclude or limit in any way our liability to you where it would be unlawful to do so.
Elevate Play may terminate your access and use of the Service immediately at any time, for any reason, and at such time you will have no further right to use the Service. You may terminate your Elevate Your Ping account at any time by following the instructions available through the Service.
The provisions of these Terms and Conditions relating to the protection and enforcement of Elevate Play's proprietary rights, your representations and warranties, disclaimer of representations and warranties, release and indemnities, limitations of liability and types of damages, ownership of data and information, governing law and venue, and miscellaneous provisions shall survive any such termination.
If an account is found to be overly inactive (not logging into the site for at least twelve months), the account may be deleted without notice. Once deleted, you will not be able to retrieve your progress, match history, or training data.
All content available through the Service, including designs, text, graphics, images, videos, information, software, audio and other files, and their selection and arrangement (the "Service Content"), are the proprietary property of Elevate Play or its licensors.
No Service Content may be modified, copied, distributed, framed, reproduced, republished, downloaded, scraped, displayed, posted, transmitted, or sold in any form or by any means, in whole or in part, other than as expressly permitted in these Terms and Conditions.
You may not use any data mining, robots, scraping or similar data gathering or extraction methods to obtain Service Content. As between you and Elevate Play, all data, information and materials generated from your access and use of the training activities and AI analysis made available on or through the Service, including analysis results generated by the Service (collectively, the "Activity Materials"), shall be exclusively owned by Elevate Play, and you shall not have any right to use such Activity Materials except as expressly authorized by these Terms and Conditions.
By using the Service, you hereby assign to Elevate Play any and all rights, title and interest, including any intellectual property rights or proprietary rights, in the Activity Materials. All rights of Elevate Play or its licensors that are not expressly granted in these Terms and Conditions are reserved to Elevate Play and its licensors.
"Elevate Your Ping" and all other trademarks, service marks, graphics and logos used in connection with the Service are trademarks or service marks of Elevate Play Pty Ltd or their respective owners, and certain of them may be registered with the Australian Patent and Trademark Office. Access and use of the Service does not grant or provide you with the right or license to reproduce or otherwise use the Elevate Your Ping name or any Elevate Play or third-party trademarks, service marks, graphics or logos.
